Complaints Procedure

This is a first draft of the document for Coinbar s. r. o. under Slovak and EU law. It has not yet been reviewed by legal counsel; the items in square brackets are still to be completed.

Coinbar s. r. o. publishes this procedure under Article 71 of the MiCA Regulation and Commission Delegated Regulation (EU) 2025/294. It explains how you can make a complaint, how we handle it and where you can turn if you are not satisfied with the outcome.

The Slovak version of this document is the legally binding one. The English and Italian versions are translations provided for information only.

1. Introduction and scope

Coinbar s. r. o. ("Coinbar") is a crypto-asset service provider. Its competent authority is Národná banka Slovenska (NBS). Coinbar maintains an effective and transparent procedure for handling complaints promptly, fairly and consistently.

Any client or potential client (for example, an applicant whose request to open an account was refused) may make a complaint. Making a complaint and having it handled is free of charge.

You may complain in particular about:

  • custody and administration of your crypto-assets (for example balances, statements of positions, crediting of crypto-asset deposits)
  • exchanges with Coinbar Direct (quote, price, commission, completion of the exchange)
  • transfers of crypto-assets (withdrawals, network fees, held or rejected transfers)
  • EUR deposits by SEPA transfer and their automatic exchange into EURC
  • account opening and identity verification (KYC/KYB), including a decision to refuse or restrict an account
  • the protection of your personal data (you may also contact the Slovak data protection authority, see section 7)
  • the conduct of our staff or the quality of customer support

By "complaint" we mean any statement of dissatisfaction with Coinbar’s services that you address to us. If you are not sure whether your message is a complaint or an ordinary request, mark it as a complaint and we will handle it under this procedure.

2. How to make a complaint

Please make your complaint in writing through one of the channels below.

Channels

By e-mail

Send your complaint to our complaints address. We recommend writing from the e-mail address registered to your account, as this makes it easier to verify your identity.

After logging in, open Support → Tickets → New ticket and choose the category "Complaint". The request is recorded as a complaint and passed to the complaints-management function, which handles it under this procedure.

Language

You can make your complaint in Slovak or English. We reply in the language in which you made it.

What to include

To help us investigate quickly, please include:

  • your first name and surname or, for a legal person, the company name and identification number (IČO)
  • the e-mail address you use for your Coinbar account
  • a description of what you are dissatisfied with
  • the dates of the events concerned
  • the identifiers of the trades or transfers concerned, as shown in the app, and for a crypto-asset transfer the blockchain transaction ID (TXID)
  • what you are asking Coinbar to do (for example a correction, a refund or an explanation)
  • copies of any documents that support your complaint (for example screenshots, confirmations or correspondence)

Never send us your password, two-factor authentication codes or other login credentials. Coinbar will never ask you for them.

Complaint form

Coinbar provides a standard complaint form in accordance with Article 71 of the MiCA Regulation and will send it to you by e-mail on request — just write to [email protected]. We recommend using the form, but a complaint made without it is handled in the same way.

3. Acknowledgement of receipt

We acknowledge receipt of your complaint in writing (usually by e-mail) without undue delay. The acknowledgement states:

  • the contact point you can reach about your complaint
  • the indicative timeframe within which we will handle it

If it is not clear who is making the complaint, or if we need to verify your identity before sharing information about your account, we will ask you to confirm it.

4. Investigation

Your complaint is investigated by Coinbar’s complaints-management function. This function is independent of the business unit whose activity the complaint concerns, and a complaint is never investigated by the person whose conduct it is about. Any conflicts of interest are managed under Coinbar’s conflicts-of-interest policy (Article 72 of the MiCA Regulation).

During the investigation we:

  • examine all relevant facts and records (for example records of trades and transfers, blockchain data and our correspondence with you)
  • may ask you for additional information or documents where needed
  • compare your complaint with our decisions on similar complaints, so that we act consistently

We investigate every complaint fairly and in a timely manner, with due regard to your legitimate interests.

5. Decision and timeframe

We decide on your complaint without undue delay and at the latest within two months of receiving it. We send you the decision in writing (by e-mail or on another durable medium) in the language of your complaint.

The decision:

  • addresses every point raised in your complaint
  • states the reasons on which it is based
  • is consistent with our decisions on similar complaints
  • if your complaint is upheld, states the measures we will take
  • if your complaint is rejected or only partly upheld, tells you about the remedies available outside Coinbar (section 7)

If, exceptionally, we cannot decide within that period, we will tell you the reasons for the delay and the date by which we will decide.

The decision cannot contain information that Coinbar is prohibited by law from disclosing — for example information on a report of an unusual transaction under the anti-money-laundering rules (zákon č. 297/2008 Z. z. o ochrane pred legalizáciou príjmov z trestnej činnosti a o ochrane pred financovaním terorizmu).

6. Complaints register and analysis

Coinbar keeps a register of all complaints received and of the measures taken in response (Article 71 of the MiCA Regulation).

  • We analyse complaints regularly to identify recurring problems and their causes, and to remedy them.
  • The complaints-management function regularly reports to Coinbar’s management on complaints and the measures taken.
  • We make the register available to the competent authority (NBS) on request.

7. Remedies outside Coinbar

If you are not satisfied with the decision on your complaint, or if we have not decided within the timeframe, you have the options below. Using this procedure does not limit these rights.

(a) Národná banka Slovenska (NBS)

Financial consumers may send a submission ("podanie") to the supervisory authority, Národná banka Slovenska. The legal basis is zákon č. 747/2004 Z. z. o dohľade nad finančným trhom (Slovak Act on financial market supervision).

NBS supervises compliance with the obligations of financial service providers, including the rules protecting financial consumers, and may act on a submission within its supervisory powers. It does not, however, decide individual disputes between clients and Coinbar: the options under (b) and (c) serve that purpose.

(b) Alternative dispute resolution for consumers

If you are a consumer, you can settle a dispute with Coinbar out of court. The procedure is governed by zákon č. 391/2015 Z. z. o alternatívnom riešení spotrebiteľských sporov (Slovak Act on alternative dispute resolution of consumer disputes).

  1. First, ask Coinbar for redress ("žiadosť o nápravu") — for example by making a complaint under this procedure.
  2. If Coinbar rejects your request for redress or does not reply within 30 days of the date you sent it, you may file an application to start alternative dispute resolution with an alternative dispute resolution body (ADR body).
  3. ADR body competent for Coinbar: [TO BE COMPLETED: ADR body competent for Coinbar s. r. o.]. ADR bodies are entered in the list kept by the Ministry of Economy of the Slovak Republic (Ministerstvo hospodárstva Slovenskej republiky).
  4. The ADR body concludes the alternative dispute resolution within 90 days of its start.

Alternative dispute resolution is available only to consumers (natural persons not acting in the course of their business or profession). The 30-day period under that Act is shorter than the timeframe for deciding on a complaint (at the latest two months); your right to turn to an ADR body is not affected by it.

(c) Courts

Independently of this procedure, you can assert your claims before the competent court. Proceedings before the Slovak courts are governed by the Slovak Code of Civil Contentious Procedure (zákon č. 160/2015 Z. z. Civilný sporový poriadok).

If you are a consumer, you may also bring proceedings in the courts of the place where you are domiciled, and Coinbar may bring proceedings against a consumer only in the courts of the Member State where the consumer is domiciled, under Regulation (EU) No 1215/2012 (Brussels I bis).

(d) Personal data protection

You also have the right to lodge a complaint with the supervisory authority under Article 77 GDPR (in Slovak proceedings, a "návrh na začatie konania" under zákon č. 18/2018 Z. z. o ochrane osobných údajov). The supervisory authority is Úrad na ochranu osobných údajov Slovenskej republiky, Hraničná 12, 820 07 Bratislava 27 (https://dataprotection.gov.sk).

8. Your rights

When you make a complaint, you have the following rights:

  • Making a complaint is free of charge; Coinbar charges no fee for handling it.
  • The fact that you have complained is never a reason to restrict, block or close your account or to worsen the terms on which we provide our services to you.
  • You may be represented by a person of your choice; the representative must prove their authority with a written power of attorney.
  • You may withdraw your complaint at any time.
  • This procedure does not limit your right to turn to the supervisory authority (NBS), an ADR body or a court.
  • We process the personal data in your complaint only to handle it and to meet our legal obligations.
